Can You Travel Anywhere with a Real ID? Understanding the Requirements

The Department of Homeland Security (DHS) is continually working to improve the REAL ID application process. Following a request for information (RFI) published on November 7, 2019, in the Federal Register, DHS sought input on technologies to aid states and residents in digitally submitting, receiving, and authenticating documents needed for REAL ID compliant driver’s licenses or identification cards. After receiving and reviewing 69 comments, DHS identified a viable option for immediate implementation by states, territories, and the District of Columbia.

As of February 19, 2020, DHS informed states that they could immediately begin accepting electronically submitted copies of source documents, subject to certain restrictions. This allows states to implement a secure electronic process for applicants to pre-submit identity and lawful status documents before visiting the DMV in person. The applicant must still physically present the same documents for authentication and verification by DMV personnel.

States had requested this capability, stating that electronic pre-submission streamlines the application process by:

  1. Ensuring applicants have the correct information.
  2. Allowing states to electronically retain information before the in-person visit.

Retaining information in advance eliminates the time-consuming activities associated with physically scanning and retaining source documents, typically done during the DMV visit. States informed DHS that this could directly reduce applicant wait times and improve customer satisfaction. DHS recommends that states consider implementing this option.

The REAL ID Act established minimum security standards for state-issued driver’s licenses and identification cards. It prohibits federal agencies from accepting licenses and identification cards from states that do not meet these standards for official purposes, such as boarding domestic flights or entering federal facilities.

DHS continues to evaluate other proposals for action and is working with the Office of Management and Budget and Congress, as necessary. While the electronic submission of documents is a step forward, the key to being able to travel anywhere within the U.S. is having a REAL ID compliant license or identification card, or another acceptable form of identification such as a passport. Check with the TSA for a complete list of acceptable documents.
